On June 28, 2023, the Conseil d'État enjoined the INAO to repeal within a fortnight the measure present in the reading guide to Regulation (EU) 2018/848 on organic production worded as follows: "The heating of greenhouses is only possible when respecting natural cycles. In this context, marketing at the production stage with organic quality for tomato, zucchini, bell pepper, eggplant and cucumber vegetables is prohibited between December 21 and April 30 in mainland France."

In application of this decision, the INAO today proceeded to remove this measure from the reading guide.
