Payment for derogations in organic farming
In the current context of budget restrictions for the INAO and contraction of its human resources, the INAO Permanent Council took the decision, on July 11, 2025, to charge for individual services rendered by the establishment, in line with the costs incurred for the instruction of these files.
This new arrangement will come into force as of January 1, 2026.
This decision concerns the following services:
- Some individual derogations provided for in the European regulation for organic farming production R(EU) n°2018/848
- Simplified parcel delimitation
Parcel identification included in the specifications, for operators who wish to have new parcels approved
Organic farming derogations
The organic farming derogations that will be affected by the payment procedure are as follows:
- Derogations relating to certain interventions on animals (disbudding, tail trimming...) - RUE 2018/848, Annex II, Part 2, point 1.7.8 - Outside derogation relating to dehorning
- Derogations relating to the use of non-organic ingredients - RUE 2018/848, article 25
- Derogations relating to the tethering of animals - RUE 2018/848, Annex II, part 2, point 1.7.5
- Derogations relating to the reduction of plot conversion periods - RUE 2018/848, article 10.3
- Derogations relating to mixed perennial crops - RUE 2018/848, article 9.8
- Derogations relating to the reduction of the conversion period of plots in the case of scientific trials with the use of a product or substance not authorized in organic production - RUE 2018/848, Annex II, part 1, point 1.7.3.b)
The derogations in organic farming that will not be affected by the payment procedure are as follows:
- Derogations relating to the introduction of non-organic animals due to high mortality (diseases (FCO, DNC...) for example) - regulation 2020/2146, article 3.2
- Derogations relating to the use of non-organic feed due to climatic hazards (drought, floods, fires...) - regulation 2020/2146, article 3.3
- Derogations relating to the dehorning of animals - RUE 2018/848, annex II, part 2, point 1.7.8
- Derogations relating to the use of untreated conventional seeds and seedlings (these derogations being managed through a dedicated platform "semences-et-plants-biologiques").
The amount per derogation request submitted is set at €30 excluding VAT (i.e. €36 including VAT at 20%), which corresponds to the average cost of the time spent by an agent processing a derogation.
Note that no reimbursement will be possible, whatever the outcome of the derogation request processing (accepted, refused, cancelled a posteriori).
Derogations are still to be submitted on the dedicated data entry platform DérogBio, with, at the time of final validation of the application submission by the operator, the requirement (as of January 1, 2026) to make an online payment.
For applications that would be sent in paper format, payment may take the form of a bank transfer (the appropriate RIB will be made available to operators wishing to follow this procedure) or payment by cheque (sent enclosed with the paper derogation application).
